Merrimack College, as a member of the Metro Atlantic Athletic Conference, Northeast Conference, Hockey East Association and the National Collegiate Athletic Association, is responsible for ensuring that conference and NCAA regulations are followed by our coaches, student-athletes, faculty and staff, donors, boosters, former students, fans and friends.

To ensure institutional control and uphold the integrity of the Department, the Compliance Office is charged with the following tasks:

INFORMATION FOR STUDENT-ATHLETES REGARDING NAME, IMAGE & LIKENESS (NIL)

Effective July 1, 2021, the NCAA has permitted student-athletes to receive compensation for use of their name, image and likeness (NIL); this decision precedes potential Commonwealth of Massachusetts and/or federal legislation regarding NIL. Until such time that governing policy is established the following guidelines are offered to help Merrimack student-athletes partake in this activity in a manner that will not jeopardize NCAA eligibility.

General principles and protocols for Name, Image and Likeness activities:

  • Student-athletes may earn compensation for their name, image, and likeness. 
  • Merrimack College and its officers and employees may not compensate or arrange compensation to a current or prospective intercollegiate athlete for her or his name, image, likeness.
  • The student-athlete's NIL activities must comply with the all applicable laws.
  • The expectation is that NIL compensation opportunities will not conflict with academic or team related activities.
  • Student Athletes will only be allowed to use Merrimack College marks and logos, including all aspects of the uniform, if those rights have been secured through an agreement granting specified rights.
  • Student-athletes must disclose within 5 days of any NIL agreements to the athletic department via forms shared through your athletic compliance forms portal. This is not an approval process but a component of NEC and Merrimack College policy; as such, access to the disclosed information will be limited to individuals with compliance related responsibilities.
  • The duration of a contract for representation of student-athlete or compensation for the use of Name, Image and Likeness may not extend beyond participation in athletic program at Merrimack College.
  • Student-athletes may secure representation (agent or lawyer), ONLY for Name, Image and Likeness and NOT for future professional athletic contract negotiations. 
  • A student-athlete under the age of 18 years must have any contract for compensation for her or his name, image, likeness, or persona approved by a parent or legal guardian.
  • International student-athletes should not enter into any NIL agreements without the guidance from the Merrimack International Student office.
  • The NEC and/or its members institutions will provide student-athletes with educational workshops focusing on areas related to Name, Image and Likeness.
  • Pell Grant or need based financial aid could be impacted based on compensation from Name, Image and Likeness. Those questions should be directed to the Merrimack College financial aid office   
  • Student-athletes are responsible for protecting their own identity, personal identification numbers, bank accounts, and any other factor or situation related to identity security. Merrimack College is not responsible for detecting, preventing, or mitigating identify theft for student-athletes as it relates to their NIL activities.

Prohibitions related to pay for play, impermissible offers and inducements or extra benefits.
 

  • NIL agreement without quid pro quo (e.g., compensation for work not performed).
  • NIL compensation provided or offered contingent on initial or continued enrollment.
  • NIL compensation contingent on specific athletic performance or achievement (e.g., financial incentives based on points scored). Athletic performance may enhance a student-athlete's NIL value but athletic performance may not be the "consideration" for NIL compensation.

Equity in Athletics - Annual Report Access

The Equity in Athletics Disclosure Act (EADA) requires that all co-education institutions of postsecondary education that receive Title IV funding and have an intercollegiate athletics program, make available an Annual Report on Athletic Program Participation Rates and Financial Support Data (The EADA Report) by October 15th of each year.
